These Terms of Use apply to your access to and use of yourgiftm.com and to purchases made from the website. The website is operated by YOUR GIFTPACK PTY. LTD. (ACN 603 863 663, ABN 79 603 863 663), referred to as “Your Giftpack”, “we”, “us” or “our”. By accessing or using this website, creating an account or placing an order, you agree to these Terms.
Nothing in these Terms is intended to exclude, restrict or modify any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or any other applicable law.
1. Use of the Website
You may use this website only for lawful purposes. You must not use the website for fraudulent or unlawful activity, attempt unauthorised access, introduce malicious code, interfere with website security or operation, scrape or commercially reproduce website content without permission, provide false or misleading information, or use another person’s payment information without lawful authority.
We may restrict or suspend access where we reasonably believe there has been unlawful, fraudulent, abusive or unauthorised activity.
2. Eligibility to Purchase
By placing an order, you confirm that you are legally capable of entering into the transaction or have the consent of a parent, guardian or other person legally authorised to act on your behalf. You must provide complete and accurate billing, shipping and contact information.
3. Product Information
We take reasonable care to ensure that product descriptions, images, specifications, prices and availability information are accurate. Minor differences may occur in colour, packaging, appearance or specifications where permitted by law. Product images are illustrative and may include props or accessories not included unless expressly stated.
4. Prices
Unless otherwise stated, prices are shown in the currency displayed at checkout. Applicable taxes, shipping fees or other charges will be displayed before the order is submitted where required. We may change prices from time to time, but a price change will not affect an order already accepted except where permitted by law.
If an obvious pricing or website error occurs, we may contact you before fulfilment and give you the option to proceed at the correct price or cancel the affected item for a refund.
5. Orders
Submitting an order is an offer to purchase the products shown in your order. Receipt of an automated confirmation does not necessarily mean an order has been finally accepted or dispatched.
We may reasonably reject or cancel an order before dispatch if a product is unavailable, payment cannot be authorised, incorrect pricing or product information has been displayed, fraud or unauthorised payment is suspected, purchase restrictions are breached, or we cannot deliver to the supplied address. If we cancel an order after payment has been received, we will refund the amount paid for the cancelled item.
6. Payment
Payment must be made using a method available at checkout. Transactions may be processed by independent payment service providers. Where payment is processed directly by an external payment gateway, we do not normally receive or store your complete credit or debit card number.
7. Product Availability
Products are subject to availability. We may reasonably limit quantities to manage stock, prevent suspected fraud or resale, or comply with legal requirements. If an ordered product becomes unavailable, we may offer an alternative, but you are not required to accept it. If the item cannot be supplied, any payment received for it will be refunded.
8. Shipping and Delivery
Shipping charges, delivery methods and estimated delivery information will be shown on the website or during checkout where applicable. Delivery timeframes are estimates unless expressly agreed otherwise. Please also read our Shipping Policy and Delivery Policy.
9. Returns, Refunds and Consumer Guarantees
Our products come with rights and guarantees that may apply under the Australian Consumer Law. Depending on the circumstances, where a product does not comply with an applicable consumer guarantee you may be entitled to a repair, replacement, refund or compensation. Our voluntary change-of-mind arrangements are separate from and in addition to your statutory rights. Please read our Return Policy.
10. Electrical Product Safety
Electrical and personal-care products must be installed, charged, operated, cleaned and maintained in accordance with manufacturer instructions and safety information. Do not use an electrical product if the product or cable appears damaged, it has been exposed to water contrary to its design, the voltage or power supply is unsuitable, or continued operation may create a safety risk.
Modification, misuse or unauthorised repair may affect manufacturer warranties, but does not automatically remove rights that cannot legally be excluded under applicable consumer law.
11. Customer Accounts
Where accounts are available, you are responsible for maintaining the confidentiality of your login details. Please notify us promptly if you believe your account has been accessed without authorisation. We may suspend accounts where reasonably necessary for security, fraud prevention or legal compliance.
12. Promotions and Discount Codes
Promotions, coupons and discount codes may be subject to separate conditions. Unless otherwise stated, discounts cannot be exchanged for cash, promotions may have expiry dates or exclusions, and offers remain subject to product availability.
13. Intellectual Property
Unless otherwise indicated, website content including text, graphics, logos, page layouts and original materials is owned by or licensed to YOUR GIFTPACK PTY. LTD. Third-party trademarks, product names, photographs and intellectual property remain the property of their respective owners. Website content may be accessed for personal and non-commercial use, but may not be commercially reproduced or distributed without permission except where permitted by law.
14. Third-Party Websites and Services
Our website may contain links to third-party websites or use services supplied by payment providers, delivery companies and technology providers. Independent third parties are subject to their own terms and privacy practices.
15. Website Availability
We aim to keep the website available and functioning correctly but cannot guarantee uninterrupted or error-free access. Maintenance, updates, technical issues or matters outside our reasonable control may occasionally affect availability.
16. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect or consequential loss arising solely from use of the website where that liability may lawfully be excluded. Nothing in these Terms excludes or restricts liability or consumer rights that cannot lawfully be excluded or restricted.
17. Privacy
Our collection and handling of personal information is described in our Privacy Policy.
18. Changes to These Terms
We may update these Terms to reflect changes to our website, business practices or applicable laws. The current version will be published on this website with its last updated date. Changes will not retrospectively remove rights relating to an order already made.
19. Governing Law
These Terms are governed by the laws applicable in Victoria, Australia. You and YOUR GIFTPACK PTY. LTD. submit to the jurisdiction of the courts of Victoria and courts entitled to hear appeals from them, subject to rights under applicable consumer legislation.
